Terms of Service

Welcome to O'Cleaner: Purify space (the “App”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and HONGKONG ARCLIGHT TECHNOLOGY LIMITED (“Company”, “we”, “our”, or “us”).

By downloading, installing, or accessing the App, you acknowledge that you have had the opportunity to review these Terms and agree to be bound by them. We encourage you to read them carefully as they contain important information regarding your legal rights.

If you find that you do not agree with any part of these Terms, we kindly ask that you refrain from using the App and remove it from your device. Your continued use of the App will be considered as your acceptance of these Terms and any future updates.

1. DESCRIPTION OF SERVICE

O'Cleaner is a high-performance mobile utility designed to optimize iOS storage via local on-device analysis. Our features include:

• Intelligent Cleanup Categories: Automated identification of Duplicate Photos, Similar Photos, Blurred Images, Screenshots, and Videos.
• Smart Recommendation System – Daily Clean-up: A dedicated entry point providing personalized recommendations for items that can be prioritized for removal based on our local algorithms.
• Time-Based Organization: Specialized views for "On This Day" (Historical memories), "Past 7 Days", and "Yesterday's Captures".
• Temporary Management: A feature allowing you to capture or tag specific images as "Temporary," with a 7-day decision reminder to help optimize your gallery.
• Priority Reminders: Items marked as "Temporary" will be prioritized in the Daily Clean-up view after their 7-day threshold.

Disclaimer: All recommendations are generated by local algorithms and are for reference only. The App does not make final value judgments on your personal memories.

2. USER LICENSE AND RESTRICTIONS

2.1 License Grant

We grant you a personal, revocable, non-exclusive, non-transferable, and limited license to use the App for non-commercial purposes on iOS devices owned or controlled by you.

2.2 Prohibited Conduct

You expressly agree NOT to:

• Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
• Distribute, rent, lease, lend, sell, or sublicense the App to any third party.
• Use the App to manage, delete, or process content that you do not have the legal right to possess or control.
• Interfere with or circumvent any security-related features or digital rights management (DRM) within the App.
• Use the App for any illegal, harassing, or unethical purposes.

3. PRIVACY AND DATA ACCESS

3.1 On-Device Privacy Commitment

Your privacy is our highest priority.

• Local Processing: Unlike traditional cloud-based tools, O'Cleaner utilizes on-device intelligence. All analysis, scanning, and cleanup recommendations are performed locally on your iPhone. Your photos and videos are never uploaded, transmitted, or stored on our servers.
• No Media Access: We do not possess, back up, or have any technical means to view your private media library.

3.2 System Permissions

To provide its core optimization features, the App requires specific iOS permissions:

• Photo Library: Necessary for the App to identify duplicates, blurred images, and large files.
• Camera: Required only if you choose to use the "Temporary Marking" feature to capture new photos directly through the App.
• Control: You retain full control over these permissions. You may modify or revoke them at any time via iOS Settings > Privacy. Please note that revoking these permissions will prevent the App from performing its essential storage-cleaning functions.

4. USER RESPONSIBILITY AND DATA SAFETY

4.1 Final Deletion Power

O'Cleaner serves as an organizational assistant, not an automated deletion system. The final decision to remove any content rests exclusively with you.

• Manual Confirmation Required: The App will NEVER automatically delete a photo or video. Every deletion requires your explicit confirmation via the standard iOS system-level prompt.
• User Review: While our algorithms provide cleanup suggestions and "Temporary" tags to save you time, you are responsible for reviewing these recommendations before confirming any deletion. We do not guarantee the permanent importance or sentimental value of any media identified by the App.

4.2 Data Recovery & iOS Safety Protocol

• The 30-Day Buffer: To protect against accidental loss, deleted items are typically moved to the "Recently Deleted" album within your iOS Photos app, where they are generally retained by the system for 30 days.
• Restoration Limits: You may manually restore items directly through the iOS Photos app during this 30-day window. O'Cleaner does not have the technical capability to access the "Recently Deleted" album or perform restorations on your behalf.
• Permanent Deletion: Once items are cleared from the "Recently Deleted" album (either manually by you or automatically by iOS), they are permanently unrecoverable. We are not liable for data loss once this window has passed.

5. SUBSCRIPTIONS AND PAYMENTS

5.1 Access and Fees

By selecting a subscription plan (weekly, monthly, or annual), you agree to the price and billing terms displayed on the payment screen. Payment will be charged to your Apple ID account upon confirmation or at the end of your free trial.

5.2 Automatic Renewal

Subscriptions automatically renew for the same duration until canceled. To avoid being charged, you must turn off auto-renewal in your Apple ID Account Settings at least 24 hours before the current period or free trial ends.

5.3 Subscription Management

You can manage or cancel your subscription anytime in your device settings. Please note: Deleting the App will not automatically cancel your subscription.

5.4 Refunds

All billing is handled by Apple. If you are eligible for a refund, you must request it directly through Apple Support. O'Cleaner does not process or issue refunds.

5.5 Changes and Access

We reserve the right to modify subscription prices or plan structures at any time. If a recurring payment fails, we may suspend your access to the service until the payment method is updated.

6. INTELLECTUAL PROPERTY RIGHTS

All rights, titles, and interests in and to the App, including but not limited to software code, UI/UX design, cleaning algorithms, logos, and trademarks, are the exclusive property of HONGKONG ARCLIGHT TECHNOLOGY LIMITED. Nothing in these Terms transfers any ownership rights to you.

7. NO WARRANTY AND DISCLAIMERS

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED:

• We do not guarantee 100% accuracy in duplicate or blur detection.
• We do not warrant that the App will be uninterrupted, error-free, or compatible with future versions of iOS.
• Recommendations provided by the "Daily Clean-up" are based on general algorithms and may not align with your personal preferences.

8. LIMITATION OF LIABILITY

IN NO EVENT SHALL HONGKONG ARCLIGHT TECHNOLOGY LIMITED BE LIABLE FOR:

• LOSS OF DATA, PHOTOS, VIDEOS, OR MEMORIES.
• SYSTEM CRASHES, DEVICE MALFUNCTION, OR STORAGE ERRORS.
• PERSONAL EMOTIONAL DISTRESS ARISING FROM ACCIDENTAL DATA LOSS.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU (IF ANY) TO THE COMPANY DURING THE LAST 12 MONTHS.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company and its officers from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms or your violation of third-party rights.

10. TERMINATION AND MODIFICATION

• Termination: We reserve the right to suspend or terminate your access to the App at our discretion, without notice, for conduct that violates these Terms.
• Amendments: We may update these Terms at any time. Your continued use of the App after an update constitutes acceptance of the new Terms.
